Data Processing Addendum

This Data Processing Addendum ("DPA") forms part of the agreement between Million Talents India Pvt. Ltd. ("Million Talents AI", "we", "us") and the client, where we process personal data on the client's behalf (for example, employee data for contract staffing payroll or workforce reporting).

Roles

For candidate sourcing and screening, we act as an independent data fiduciary/controller. For data the client provides for payroll, reporting or onboarding, we act as a data processor acting on the client's documented instructions.

Our obligations

  • Process personal data only on documented instructions from the client.
  • Ensure personnel are bound by confidentiality.
  • Apply appropriate technical and organisational security measures.
  • Engage sub-processors only under written terms with equivalent protections, and inform the client of changes.
  • Assist the client with data principal requests and data protection impact assessments.
  • Notify the client without undue delay after becoming aware of a personal data breach.
  • Delete or return personal data at the end of the services, unless law requires retention.

International transfers

Where personal data is transferred outside India, we do so in compliance with the DPDP Act and, where applicable, GDPR transfer mechanisms.

Audit

On reasonable notice, we will make available information needed to demonstrate compliance with this DPA.
